Terms of service
Draft, for review by our solicitor. Not yet in force.
These terms are the agreement between you and PowSoft Ltd, a company registered in England and Wales (company number 16761223, 128 City Road, London EC1V 2NX), which runs Swing Traders Corner ("we", "us"). By creating an account or using the API, you agree to them.
1. What the service is
Swing Traders Corner publishes trading signals for US stocks, once each trading day after the US close, through a website and an API. A signal records what a published method, W.D. Gann's swing charts as amended by Marc Rivalland, detected at that day's close: a signal type, an entry level and a stop level.
- Every subscriber to a plan receives the same signals. They are general information, published to everyone on the plan alike.
- They are not personal recommendations. We don't know your finances, goals or circumstances, and we don't consider them.
- A signal is not an offer to buy or sell anything, and not a promise about what a price will do.
- We don't hold your money, place your orders or manage your account.
Our free course, examples and charts explain the method. They show how signals work; they aren't recommendations either.
2. Who can use it
The service is for people who live in the United States and are at least 18. At sign-up you confirm that you are a US resident, and you give your country and state. We may refuse or close an account if the details are untrue, or if we open or close the service in your state or country.
Outside the United States the service isn't available yet. You can join the waiting list.
3. Your account and API key
- Keep your password and your API key private. You're responsible for what's done with them.
- One person, one account. A key is for your own use and isn't to be shared, sold or published.
- If a key has been exposed, regenerate it on your account page. The old key stops working at once.
- Keep to the plan's limits (calls per minute, and a monthly fair-use allowance). We may slow or pause an account that goes well beyond them.
4. Plans, trials and payment
[Wording to follow with the payment provider's checkout and the solicitor's advice on US renewal and cancellation rules.]
The Free plan costs nothing and shows signals three trading days after they were published. Paid plans show them the same evening. A free All US trial lasts 14 days from the time you start it. When it ends, your account returns to the Free plan unless you've subscribed.
5. What you may do with the signals and data
You may use the signals, charts and data for your own trading and research, in your own spreadsheets, scripts and platforms.
You may not, without our written permission:
- resell, redistribute or publish the signals, charts or data, or any substantial part of them, or make them available to anyone who hasn't subscribed;
- build a service from them for others;
- copy the service's history or data in bulk by any route other than the API within your plan's limits;
- use the service to compete with it.
The prices behind the signals and charts come from third-party providers. They are licensed to us for the service, and these restrictions are part of what we agree with them.
6. Accuracy and availability
We take care over the data and the calculations, and we cross-check prices. We can't promise they are free from error: a provider's price may be wrong, late or missing, and a signal can be affected. Signals may be late, may not be published on a day, or may change if a price is corrected. The service may be unavailable from time to time.
7. Risk
Trading and investing carry risk, and you can lose some or all of the money you put in. A signal that has worked before may not work again. Examples, charts and course pages show how the method behaves; results from past signals, including examples and backtests, don't predict the results of future ones. Hypothetical and backtested results are not the results of real trading, and they have limits explained in our disclaimer.
You decide whether to act on a signal, how, and with how much, and you bear the outcome.
8. No warranties, and limits on our liability
The service is provided as it is. We give no warranty that it is accurate, complete, uninterrupted or suitable for any purpose.
To the extent the law allows, we aren't liable for trading losses, lost profits, or indirect or consequential loss arising from your use of the service, or from a signal, a price or a chart. Nothing in these terms limits liability that can't be limited by law, for example for fraud or for death or personal injury caused by negligence. [Cap on liability and governing law: to be settled with the solicitor.]
9. Ending the agreement
You can close your account at any time from your account page. We may suspend or close an account that breaks these terms, or if we stop offering the service in your state or country. A paid plan that you close runs to the end of the period you've paid for. [Refund wording to follow.]
10. Changes
We may change these terms, and will say so on the site and by email for changes that matter. Using the service after a change takes effect means you accept it.
